A SKIPTON man told officers "I'm absolutely shattered, let me get to sleep" when asked to carry out a breath test at the police station.
James Miller, 21, had been arrested and taken to Harrogate Police Station after providing a positive road side breath test, heard Skipton Magistrates Court.
But at the police station he refused to carry out the evidential test telling officers he was tired and wanted to sleep.
Miller was subject of a 18 months suspended prison sentence at the time for a dissimilar matter, the court heard.
In court on Friday, Miller pleaded guilty to failing to provide specimen for analysis at Harrogate Police Station on June 9. He also accepted that it had happened while he was subject to a suspended prison sentence.
Mitigating, Keith Blackwell, said Miller had fully cooperated with the police until he got to Harrogate and had he given a sample he may have been under the limit.
"He told the officers he was very tired, "said Mr Blackwell.
Miller, of Walton Street, Skipton, is due to be sentenced at the Skipton Court on August 23 following a pre-sentence report. Magistrates imposed an interim driving ban.
